منظمات حقوقية تطالب بالإحالة إلى المحكمة الجنائية الدولية
قامت أكثرمن مئةمنظمة منالمجتمع المدني من مختلفأنحاءالعالم بإصدار البيان التالي اليوم، لدعوة مجلس الأمن الأممي إلى الموافقة على قرار بإحالة الوضع في سوريا إلى مكتب الادعاء بالمحكمة الجنائية الدولية.
إننا، نحن منظمات المجتمع المدني الموقعة أدناه، نحث أعضاء مجلس الأمن التابع للأمم المتحدة على الموافقة على مشروع قرار يؤيده ائتلاف واسع من البلدان ومن شأنه إحالة الوضع في سوريا إلى مكتب الادعاء بالمحكمة الجنائية الدولية. بعد مرور أكثر من ثلاثة أعوام على بداية نزاع حصد ما يزيد على مئة ألف نفس، بحسب الأمم المتحدة، ما زال يتم ارتكاب جرائم فظيعة في إفلات تام من العقاب من جانب طرفي النزاع، بلا نهاية في الأفق المنظور. ولم تتخذ السلطات السورية ولا قادة الجماعات المسلحة غير الحكومية أية خطوات جدية لضمان المحاسبة على الجرائم الحقوقية السابقة والمستمرة. ولم يعمل الإخفاق في محاسبة المسؤولين عن هذه الانتهاكات إلآ على تشجيع ارتكاب جميع الأطراف للمزيد من الفظائع. ونحن، على خلفية الوضع المذكور، نرى أن المحكمة الجنائية الدولية هي المنتدى الأقدر على التحقيق والملاحقة الفعالين للأشخاص الذين يحملون المسؤولية الأكبر عن الجرائم الخطيرة، وعلى تقديم قدر من العدالة للضحايا في سوريا. وقد وجد آخر تقرير من بعثة الأمم المتحدة لتقصي الحقائق في سوريا، الذي صدر في 5 مارس/آذار 2014، أن جميع الأطراف في النزاع السوري استمرت في ارتكاب جرائم خطيرة بموجب القانون الدولي، واعتبر أن مجلس الأمن قد أخفق في اتخاذ إجراءات لإنهاء حالة الإفلات من العقاب. وأوصت البعثة، التي نشرتسبعة تقارير معمقة منذ تشكيلها في أغسطس/آب 2011، بقيام مجلس الأمن بمنح المحكمة الجنائية الدولية الاختصاص للتحقيق في الانتهاكات في سوريا. كما أن الحاجة إلى المحاسبة في سوريا من خلال المحكمة الجنائية الدولية قد وجدت تأييداً مماثلاً من أكثر من 60 بلداً من أعضاء الأمم المتحدة، تمثل كافة مناطق العالم، وبينها 10 من الأعضاء الحاليين في مجلس الأمن. ونحن ندعو كافة أعضاء مجلس الأمن إلى تلبية هذا النداء من أجل العدالة. وعلى البلدان الأخرى تأييد مشروع القرار علناً، وتحذير روسيا والصين من استخدام حق الاعتراض لعرقلة المحاسبة على الانتهاكات من جانب جميع الأطراف. ولقد أنشئت المحكمة الجنائية الدولية، كمحكمة دولية دائمة مختصة بملاحقة جرائم الحرب والجرائم ضد الإنسانية حين تعجز السلطات الوطنية أو تمتنع عن القيام بذلك، خصيصاً للتصدي لأوضاع من النوع القائم في سوريا اليوم. ورغم أن عمل المحكمة لن يكون سوى جزءاً واحداً من الجهد الأوسع نطاقاً المطلوب للمحاسبة في سوريا، إلا أنه خطوة أولى حاسمة. وعليه فإننا نتشدد في دعوة أعضاء مجلس الأمن إلى العمل بشكل عاجل إلى سد فجوة المحاسبة في سوريا، فالشعب السوري لا يستطيع تحمل المزيد من الإحباط أو التأخير.المنظمات الموقعة بالترتيب الأبجدي بالإنجليزية:
